Problems of Realization of the Right to Judicial Protection in Civil and Administrative Proceedings

The article is devoted to the main points of the report of civil procedure section at joint international science-practical conference «Protection of Rights and Freedoms of the Individual in the Modern World» (22–24 November 2016), which was a part of the VI Moscow Law Week program. Problems of realization of the right judicial protection in civil and administrative proceedings arise mainly due to the lack of procedural guarantees or reduction of their level. Guarantees of the right to judicial protection usually (first of all) mean an access to court and a fair trial. In considering these guarantees it is also important to pay attention to problems that complicate the realization of the right to judicial protection of civil rights. Currently, it can be stated that there are three large groups of issues: organizational, financial and economic, legal. The solution of some problems identified in the article will create necessary guarantees for the realization of the right to judicial protection, to increase the effectiveness of judicial protection, and as a result, the number of citizens who trust the justice system.
