Actionability: In Search of the Lost Tradition?

The article is devoted to the category of actionability in civil procedure. In the process of solving concrete problems legislative practice and jurisprudence refer to the ontology of procedure, historical paradigm and its evolution not often. According to the author, lack of this approach makes difficulties to output of effective and professionally not contradictory methodology for solving concrete issues. That is why the author refers to some of basic categories of civil procedure, which make connection between procedure and law, and where the category of actionability (Klagbarkeit) plays one of the first roles. Understanding of the actionability was and still is different; there is no unified view of origins and nature of the actionability and two approaches have received the largest recognition: (1) substantive and (2) procedural. Nowadays idea of the actionability as a certain competences and possibility, as an element of substantive claims is usual. The author expresses the view that civil procedure of the XXI century, being on a different historical stage of development, «returns» to the methodology of actionability, which was formed through the Roman understanding of the claim: as an expression of the relations between disputing parties and as a term which has its own «objectivity» and independence.
