 CHAPTER 22.2 “THE PROCEDURE FOR CONSIDERATION OF REQUESTS FOR THE RETURN OF THE CHILD OR IMPLEMENTATION THE RIGHTS OF ACCESS IN RESPECT OF A CHILD UNDER AN INTERNATIONAL TREATY OF THE RUSSIAN FEDERATION” 

In this section of the review we are talking about the procedure for consideration of applications for the return of the child or implementation the rights of access in respect of a child under an international treaty of the Russian federation. The appearance of this Chapter in the Code of Civil Procedure related to the participation of the Russian Federation to the Hague Convention “On the civil aspects of international child abduction” of 25 October 1980 (hereinafter the Convention), aimed at ensuring the immediate return of children wrongfully removed abroad of the state of their habitual residence or unlawfully retained outside of it, as well as to ensure that rights of custody and of access under the legislation of one Contracting state are effectively respected in other Contracting States. It should be borne in mind that the Convention applies to any child who was habitually resident in any state party to the Convention immediately before the violation of the rights of custody or access. In this case the Convention shall cease to apply if the child reaches the age of 16.
