Is a Judicial Review of Normative Legal Acts (or Their Separate Provisions) Become Inoperative Permissible?

The article analyzes the possibility of challenging in the court normative acts become inoperative. The interested person, in particular, can protect his rights not by contesting regulatory legal acts become inoperative at the time of his going to the court, but appealing based on them decisions and actions (inaction) of authorities and officials, for recognizing which illegal there are no obstacles, because the court, having established the illegality of an act of a state or other authority (including become inoperative) with the act more legal force, decides in accordance with the latter. Regarding regulations become inoperative at the time of going to the court, an abstract judicial review is unacceptable, only a concrete way of judicial review is possible. The court may not terminate proceedings about contesting the normative legal act recognized as inoperative by the decision of the authority or person passed it after the filing to the court a declaration, if during a trial it will be established that the contested normative legal act violates rights and freedoms of the applicant guaranteed by the Constitution of the Russian Federation, laws and other normative legal acts.
