Some Problems of Correlation of Civil and Administrative Proceedings in Courts of General Jurisdiction

The article is devoted to determination of the order of consideration of requirements of individuals and organizations associated with the implementation of judicial control of administrative acts. The error in determination the type of proceedings before the adoption of the Code of Administrative Procedure of the Russian Federation could not in itself lead to abolition of the judicial decision, because litigation from public relations is still viewed as a form of civil proceedings. At the present time consequences of incorrect determination of the type of legal proceedings are different. According to paragraph 1 of Part 1 of Article 128 of the Code of Administrative Procedure of the Russian Federation the court refuses to accept the application, if the application is not subject to consideration in the administrative proceedings, and should be considered in another court, including civil proceedings. Similar provisions are contained in paragraph 1 of Part 1 of Article 134 of the Civil Procedure Code of the Russian Federation: the court refuses to accept the claim, if the claim is not subject to consideration in civil proceedings, as it is seen in other legal process.
