This section provides the commentary to the Chapter 1 of the Federal Law «On arbitration courts in the Russian Federation». This Law regulates two groups of issues related to arbitration courts: 1) issues of their education and 2) issues which regulate their jurisdictional activities. The scope of the Law on arbitration courts is limited solely by arbitration courts located in the territory of the Russian Federation. Thus, the establishment and operation of foreign arbitration courts are not subject to normative regulation of this Law. To obtain the potential recourse to the arbitration court for protection of violated or disputed rights the parties of the relationship have to reach a special agreement. Fe scope of the Law on arbitration courts is limited at the legislative level only by domestic arbitration courts. International commercial arbitration courts on the territory of the Russian Federation are not fitted under the normative regulation of this Law – these are arbitration courts in which cases a foreign physical or legal persons, or a Russian company with foreign investment are at least a one of the parties.
