Judgments of the ECHR in Civil Procedure: Reload?

The article analyzes questions of influence of judgments of the ECHR on civil proceedings in the Russian Federation. The discussion focused on the following problem. The Civil Procedure Code of the Russian Federation does not provide the possibility of judicial review of decisions on newly discovered circumstances after the ECHR found a violation of the Convention for the Protection of Human Rights and Fundamental Freedoms. The situation changed after the Constitutional Court of the Russian Federation adopted the Judgment of February 26, 2010 No. 4-P «On the case of constitutionality of Part 2 of Article 392 of the Civil Procedure Code of the Russian Federation Pursuant to the Appeals of Citizens A.A. Doroshek, A.Y. Kot and Y.Y. Fedotova», in which explained that Part 2 of Art. 392 of the Civil Procedure Code of the Russian Federation – in its constitutional and legal meaning in the current legal regulation, taking into account the proclaimed in Article 15 (Part 4) of the Constitution of the Russian Federation priority of rules of the international treaty of the Russian Federation – can not be regarded as allowing to the court of general jurisdiction to refuse in review of the judgment rendered by them on newly discovered circumstances at the request of a citizen in the case if the ECHR found a violation of the Convention for the Protection of Human Rights and Fundamental Freedoms in consideration of a particular case.
