On the Issue of Participation of Third Parties without Independent Claims Concerning the Subject of the Dispute at the Court of Appeal

The article examines issues of the participation of third parties without independent claims concerning the subject of the dispute at the court of second instance; analyzes problems of this legal institution in law enforcement; examines ways of its further development. Nonjoinder of a third party without independent claims concerning the subject of the dispute may lead unfavorable consequences to an interested party; the avoidance of a third party of participation in the process leads the same consequences for him. In such cases, the court’s decision has the same effect for him as for persons involved in the proceedings in the trial court, conclusions contained in the judgment are prejudicial for him. The fact, that a third party without independent claims concerning the subject of the dispute has not substantive relationships with the opposite side, that these third parties are beyond dispute between the plaintiff and the defendant of legal relationship, affects on his procedural rights as well.
