To the Issue of the Publication of Judgments of the ECHR in Russia and Its Use in Legal Practice

There are still more questions than answers in the scope of application of translations of judgments of the ECHR on Russian. There is currently no consensus on methods of application of the ECHR decisions in Russia, including with respect to the order of familiarization with them by participants of the process. This article focuses on the subject of legal power of translations and methods of its use by the Russian courts. In view of often recognized the effect of the direct action of the ECHR judgments for the judiciary and other national authorities in a variety of states, simple publication and dissemination of judgments of the ECHR, on the ability passing by instructions/recommendations, is considered in most cases by the Committee of Ministers of the Council of Europe (CMCE) as sufficient to ensure necessary changes in law and practice to prevent further violations and to ensure the effectiveness of internal sources. Brighton Declaration on the results of the Summit Conference on the future of the ECHR (2012) regards the publication or summarizing of important decisions of the ECHR in the national language as the recommended measure to improve the application of the Convention for the Protection of Human Rights and Fundamental Freedoms. This article contains practical recommendations for improving enforcement.
