The Principle of Priority of Civil Procedure of the EU and Features of Its Implementation

The author analyzes questions related to the implementation of provisions of the first common European procedures for dealing with minor disputes and granting a court order. The emergence and development of civil procedure of the EU associated with spread of cross-border disputes inside the EU that began disputes between citizens of different EU member states in courts of other EU member states. Significant differences between civil procedural systems of different countries after their union became a particular barrier to protect rights of their citizens. At the same time principles and ideas of civil procedure of the EU become important, one of which is a priority of its provisions at considering and resolving of cross-border disputes. The research of provisions of the European legislation and practice of European Court of Justice makes it possible to define its essence, to allocate its items. In the future study of the nature of this principle will make it possible to resolve problems arising from the harmonization of civil procedural law of EU member states and participants in association with the EU.
