Problems of Commencement of Cassational Proceedings in the Light of the Concept of the Unified Civil Procedure Code of the Russian Federation

The author analyzes the modern condition and perspectives of improvement of issues related to commencement of cassational proceedings due to acceptance of the Concept of the Unified Civil Procedure Code of the Russian Federation. In administering of justice, unfortunately, courts of first instance allow violations of substantive and procedural law. Moreover, even courts of second instance, which, as a rule, successfully cope with functions of the judicial audit with respect to courts of first instance, from time to time, not only do not notice errors of lower courts, but they themselves sometimes admit violations of the law, which can be conditionally called «judicial errors». In order to eliminate errors that occur in judicial decisions that have entered into force, the legislator provides for the procedure for the cassational revision of judicial decisions. The subject of review in cassation are all judicial decisions which have entered into force, except for judgments of the Supreme Court of the Russian Federation.
