Courts of Arbitration: History and Modernity (in the light of the discussions about the reform of the legislation on arbitral courts)

The article is devoted to the history of arbitral courts and arbitral procedure. Arbitration as a form of resolution of legal conflicts originated long ago, in the era of customary law. It should be noted that in this case, you can talk about the very idea of the Court of Arbitration (Court of Mediation), but not about the legal regulation of the institution. As a rule, optionality or binding by the relevant dispute resolution through merely referred to in the Act, but no detailed regulation is not provided. In fact, we can say that until the XVIIth century, no coherent regulation here did not exist at all, that shows the study of works on the history of Russian court procedure. At the time of the Judicial Reform of 1864 arbitral procedure also has undergone a number of changes, the provisions on arbitral proceedings have been included in the Civil Procedure Act – Charter of Civil Procedure. But even then the arbitral procedure was used for unlawful purposes (e.g., removal of property under distraint).
