Main Provisions of the Concept on the Institution of a Reconciliation of the Parties in Civil Proceedings (second part)

In the article authors continue to analyze the Conception of the Unified Civil Procedure Code of the Russian Federation as applied to a reconciliation of the parties. The evaluation of the all reconciliation procedures provided for by Conception (negotiations, reconciliation of payments, mediation and judicial reconciliation) is given. The authors mark out the peculiarities of the referred above reconciliation procedures and suggest the terminological fixation and the versions of legislative regulation. As for reconciliation of payments there are the arguments in accordance with such a method cannot be considered as a reconciliation procedure per se. But it is one of the procedural means that might facilitate parties’ reconciliation along with discovery, pleading and other similar procedural mechanisms.
