Scope of the Decisions of the Constitutional Court of the Russian Federation as a Hermeneutical Acts of Civil Procedural Law

Article is devoted to the operation of the acts of the Constitutional Court of the Russian Federation in civil proceedings. The decisions of the Constitutional Court of the Russian Federation (and that they are different from other hermeneutical judicial acts) are the result not of abstract normative control, but a result of a complaint or inquiry on a particular legal situation. In this sense, it can be argued that such a decision is law enforcement. In contrast to the judicial judgements as the enforcement acts, decisions of the Constitutional Court of the Russian Federation are spreading their action not only on the subject, which dealt with a complaint or query, but also to other persons, applying the rule is subject to review in the context of Constitutional Court of the Russian Federation. This property of analyzed judicial acts gives grounds to believe that the decision of the Constitutional Court of the Russian Federation is the official act of judicial interpretation. If as a result of the complaint or query a normative act or its separate provisions were unconstitutional, it loses its force upon proclamation of the decision. Judgements of courts and determinations other authorities made under acts declared unconstitutional shall not be enforced and should be reviewed in the cases established by federal law. At the same time enforcement authorities are obliged to take into account the legal position of the Constitutional Court of the Russian Federation since the entry into force of the decision.
