Category «Level of System Structure of Civil Procedure Law»: Concept, Theoretical and Practical Significance

The article is devoted to analysis of the system of civil procedural law, levels of this system. Civil procedural law taking independent and exact place in the system of law, too, is a multilevel, hierarchical system. It can also be represented as a pyramid, emerging from the subsystems of different levels: legal rules, are arrayed in the institutions that make up the association of institutions that, in turn, constitute legal systems or sub-branches of the law. These units in its unity form a system of civil procedural law. Each level of structure of the system it is a holistic and relatively autonomous legal system, which is formed of lower-level subsystems and, in turn, can be regarded as a subsystem of a higher level. This category is directly related to the scientific development and implementation in the legislative practice of general and special rules of civil procedure. Review of general and special norms through the prism of a certain level of civil procedural law helps to better understand the logic of the internal structure of this branch of law, explain the reasons for the antinomies and identify ways to eliminate them, properly solve the problem of its improvement.

Keywords: system of civil procedural law; level of system structure; general and special procedural rules; types of trials; antinomies; inconsistencies in the civil procedure law.
