Security for a Claim in Civil Proceedings in the Court of Appeal

This article analyzes the admissibility of securing a claim in civil proceedings in the Court of Appeal, including the denial of the claim, cancellation of interim measures by the court of first instance, before the hearing on the appeal. Civil Procedure Law does not give a clear answer to the question of time limits securing of claim, anyway – at what stage of the process and in some instances the court may adopt interim measures. In Art. 139 of Civil Procedure Code of the Russian Federation is only mentioned that security for a claim is allowed at any stage of the proceedings, if the failure to secure a claim may make it difficult or impossible to enforce a decision. At the same time, based on the objective procedural institution of any claim and to ensure effective judicial protection providing the court of second instance should be allowed regardless of the outcome of the case and resolve the issue with the measures in the first instance, if required by the particular circumstances of the case and the failure may make it difficult or impossible to enforce a decision upholding a claim.
