Reforms of the Civil Procedural Law in the Third Polish Republic

The first Code of Civil Procedure of Poland (1933) borrowed provisions of the Civil Procedure Code of Germany (1877) and Civil Procedure Code of Austria (1895), which had previously operated in some regions of Poland. After the Second World War, the civil procedural law of Poland was reconstructed in accordance with the so-called Soviet model. Separate rules of law were to be changed, as well as the principles of civil procedure were overrated. Polish reform of civil procedure, conducted after the political changes of 1989 were due to various reasons. Initially, it was obvious that the «socialist» Polish civil procedure must be converted to a civil process of a modern democratic state and comply with the new socio-political conditions of life. Acceleration of the civil process and improving the effectiveness of legal protection by the State courts were the main objectives of the reform. Despite the persistence of second sentence of Art. 323 of Polish Civil Procedure Code power of the court to collect evidence which is not submitted by the parties, evidence collection ex officio is no longer the duty of the court.
