The Court as a Participant of Evidence in Civil Proceedings

The need to distinguish between the activities of the courts and the activities of persons involved in a case is objectively. Court and persons involved in the case are the subjects of procedural relations that perform various functions in the proceedings. Functions of the persons involved in the case stemmed from an adversarial form of civil procedure and the status of the alleged participants in the substantial relationship, the nature of the interest in the case and, in turn, its procedural tasks. Functions other actors defined their assigned procedural duties and granted rights. The function of the Court as a judicial body is the resolution of the merits of the case as a form of implementation of the plenary powers in the field of substantive law. In addition, the Court has the procedural process management functions, as well as participants in the process of providing assistance in the realization of their rights. Evidence in the trial court of first instance completed the formulation on the basis of the evidence collected conclusions about the presence or absence of the required facts and fixing these findings in the reasoning of judicial decision.
