About Some Aspects of the Right to Judicial Protection of the Incapacitated and Partially Incapacitated Persons

In article taking into account historical digression discusses the problem of realization of the right to judicial protection by persons which have been recognized in the order established by the law by incapacitated or partially incapacitated is considered. It is proved, that in the Romano-Germanic legal family concerning the specified persons various remedial restrictions that has been caused by features of their substantive status were traditionally used, not allowing to the full to participate in personal property and non-property, and, hence, in procedural relations. The conclusion that now under the influence of various norms of international law the legal doctrine and judiciary practice gradually began to change own representation about a nature of the rights, freedoms and legitimate interests of the persons incapacitated and limited in capacity becomes. In the international contracts and recommendations the trend to refusal of rigid medical model of incapacity, differentiation of formal and functional incapacity, and also to transition to the formula of the minimum restriction of the rights of citizens, including in sphere of civil justice is traced. The last needs to be taken into consideration during the further reforming and perfection of the domestic civil remedial legislation.
