Place and Importance of International Law in the System of Sources of Civil Procedural Law

The norms of international law in the article are considered as source of civil procedural law. The author explores the conсepts of generally recognized standards and norms «jus cogens». In the article are analyzed Arts. 1(2) and 11(4) the Civil Procedure Code of the Russian Federation, and is made a conclusion that the norms of international law as a source of Russian law applicable to the proceedings and its follow-up. Most of all, it is considered a question of the place of international agreements in the hierarchy of the sources of the civil procedural law depending on the scope. Among other things, rise other problems of implementation of international law as a source of civil procedural law. The principle of international cooperation in civil proceedings acquires practical importance when considering cross-border civil cases, in particular with respect to the execution of court orders, recognition and enforcement of Russian and foreign judgements. Cooperation at the international level has its origins in the postulate of equality of States, respect for each other, in mutual assistance to foreign persons in the protection of their civil rights.
