The Legal Consequences of Ungrounded Non-Normative Legal Acts When They Is Appealed in the Courts

The author in the article raises the problem of one judicial acts in the light of the denial of the right to appeal against this act of dissenting party. Notes that the right of citizens to the motivation of non-normative acts of the state bodies (including the courts) is not so much a right to be heard, that too is the right to a reasoned response has the duty to respect the dignity of the individual. The right to be heard is just one manifestation of the duty to respect the dignity of the individual, this duty is much broader and is not limited by a demonstration that the man was heard and heeded. Recognition of the dignity of a person implies the duty of public authorities to be in a dialogue with the citizens and their associations, that would be fully compatible with the requirement of not only external, but also included are the desire to be understood. Respect for human dignity does not allow ignoring communication and formal communication that does not contain a real understanding and creating understanding.
