The Specificity of Action Proceedings Rules in Insolvency (Bankruptcy) Cases

This article analyzes the features of insolvency (bankruptcy) proceedings as a complex type of proceedings. The author singles out claims procedures in insolvency (bankruptcy) cases, and reviews the specificity of the applicability of the action proceedings rules in insolvency (bankruptcy) cases. Insolvency (bankruptcy) proceedings is a complex type of proceedings, which is a integral unity of action, application and administrative proceedings. However, in bankruptcy cases one and the same legal remedy, for example, a declaration of acceptance of the debtor-bankrupt, can acquire action or application proceedings’ features, depending on who takes this statement and whether there was between the parties (the bankruptcy creditor and debtor) a conflict of interest. Very interesting is the question of the relevance of declaration of invalidity of actions (inactivity) of the insolvency administrator, as well as to remove it from their duties to action proceedings or litigation arising out of administrative and other public legal relations.
