The Concept of Immunities in the Civil Procedural Law

The article analyzes the problems associated with the use of categories of immunity in civil proceedings in Russia. In this article the characteristic of nature of the immune system and its role in civil litigation and enforcement proceedings are given. From the analysis of the civil procedural literature we can conclude that the topic of immunity in civil procedural law of Russia is at an early stage of its development, there is no generally accepted notion of immunity in civil proceedings, undefined the place of this institution in the system of civil procedural law of Russia; and also unclear the relationship of the immunity with the adjacent civil procedural categories. Currently, the Russian civil proceedings referred to the following categories of immunities: conditional (e.g., when a witness is entitled, but not obliged to testify) and unconditional (in particular, the inability to interrogate someone as a witness) immunities; immunity of the state (excluding the case from the jurisdiction of a court of a State, when another sovereign State is a party of the case); diplomatic immunity. Diplomatic immunity suggests that the diplomatic agent cannot be forced to become the subject of these relations. Immunity of state assumes excluding the cases, where another state participates as a party of the disputed legal relations, from the jurisdiction of the court of any other state.
