Correspondence Principle in a Positive Legal Procedures

The article considers the demonstration of in absentia in positive legal procedures in the course of right realization, the current legislation in this area is analyzed. On separately followed example the perspective of realization of in absentia procedures at registration of the rights for real estate and transactions with it is revealed. The positive process within law enforcement can be allocated when there is no dispute between participants and there is no possibility of application of coercion. The in absentia principle appears in considered positive legal procedures at introduction in process of information and communication technologies which allow excluding participation of the person at implementation of concrete functions, by means of their electronification and automation. It is important to decide at what level the in absentia procedures can be applicable, how granting the state services in such form can end, since not all types of realized functions need the paper document or its electronic copy as a result, sometimes registration, for example, in the register, the list and other is necessary. The author draws a conclusion that the majority of the state services needs to be automated. Their in absentia rendering will allow to reach the maximum transparency, to minimize corruption, an abuse of power, to exclude a subjective discretion that, Finally, will reduce time of realization of discussed procedures and number of officials, and as a result, we hope, it will lower the costs of their granting.
