Revision on Newly Discovered or New Circumstances of the Court Rulings that Entered into Legal Force: On the Essence and Legislative Contradictions

The article is devoted to the nature of the revision of effective judicial acts due to new or newly discovered circumstances. Le innovations entered by Federal Law of the Russian Federation of December 9, 2010 No. 353-FZ, and their interpretation by the highest judicial authorities are analyzed. The objects of the revision due to new or newly discovered circumstances could be: effective decisions of the courts of the first instance; rulings of the courts of the appellate instances; judgments and rulings of the courts of the cassational instances; judgments of the Presidium of the Supreme Court of the Russian Federation. The current procedural legislation formulates two groups of circumstances that can be grounds for the revision of the effective judicial act by the court that adopted this act (arts. 391– 393 of the Civil Procedural Code (CCP)): newly discovered circumstances (subpara. 1 of para. 2, para. 3 of art. 392 CCP) and new circumstances (subpara. 2 of para. 2, para. 4 of art. 392 of the CCP). At the revision due to newly discovered circumstances, there is a presumption about existence of the circumstances at the time of consideration of the case which – if they were known – could influence the determination of a subject of process and the conclusions of the court on the merits of the case. The newly discovered circumstances are not connected with judicial error, since they were unknown to the court because of objective reasons, not depending on will of interested persons and the court.
