On the Prospects of Private and Public Basis in Civil Proceedings

The article is devoted to development of the private and public basis in civil process. The rules governing the relations, arising in connection with consideration of civil cases by court, in the vast majority belongs to that part of the law which is directly connected with authoritative activity of the state. The attention of scientists to issues of a correlation of private and public issues in a procedural law is in many respects connected with the objective processes in the Russian legal system as a whole. The reached level of freedom of participants of a civil circulation, autonomy of the personality in implementation of decisions made by it, lead to the need of development of a private-law segment not only in the sphere of material law, but also procedural law. It is a condition of full realization of economic freedom, independence and equality, protection of dignity of the personality, inviolability of property from any encroachments, effective protection of the rights of participants of a circulation against arbitrariness of certain persons acting on behalf of the state. The author draws a conclusion that the method of authoritative regulations is an administrative ground of the public basis in civil process and, on the contrary, the method of stimulation of certain kinds of activity is an administrative ground of the private-law basis.
