The article is devoted to the problems of determination of a type of civil legal procedure within which concrete civil case is considered. Determination of the branch of norms of a substantive law is important for determination of a type of the civil legal procedure. The wrong determination of a type of legal procedure can be the basis for judgment cancellation, and the theoretical problem gets quite practical outlines. Therefore, despite debatable character of this problem, there are all grounds to oMer options of its solution, using the known general-theoretical structures, and considering the jurisprudence which has developed on these procedural issues. According to a type of civil legal procedure, the separate procedural rights, duties of the persons participating in the case, burden of proof assigned to them are defened. Le correct explanation of the procedural legal status of the subject allows to take the first step on a way of determination of a type of civil legal procedure and to limit the area of norms applicable to these legal relationships. In cases of special proceedings, the objective side is related not to actions of other subjects, but to existence of vital circumstances which demand determination of their legal destiny, legal ascertaining of the developed phenomena, relationship, a situation by the court. The object of the adversarial proceedings is settlement of issue at law; for proceeding on cases arising from public relations – implementation of judicial control of legality of actions of the public subject; for special proceedings – establishment of legally significant facts and capable to influence the emergence, change or termination of legal relationship, and in some cases – recognition of the certain legal consequences connected with establishment of the facts.
