Civil Remedial Aspect of Realizations of the Reproductive Rights and Duties

In article on an example of consideration of courts of the general jurisdiction of the civil cases arising from social relations, the auxiliary reproductive technologies connected with application, investigate a problem of effciency of the existing mechanism of civil remedial regulation. He conclusion that the given mechanism is articial in the created closed social system is initially adapted on the permission more or less standard legal incidents that is why it is not capable to react to not ordinary legal and actual situations effectively enough. However objective change of the base scientifical and practical approach to a subject of judicial activity should be reffected inevitably in static character of the speciffed closed system, to force evolve towards interaction with the external public environment. It takes place First of all by means of loan and use of the natural-legal concepts and the ideas that have received approbation and Flexible applied application in activity of the European Court of Human Rights. He European Convention for the Protection of Human Rights and Fundamental Freedoms states that everyone has the right to respect of family life. Intervention of the public authorities in implementation of this right isn’t allowed, except for cases when it is directly provided by the law and it is necessary in democratic society in interests of national security and a public order, for health protection or moral.
