Common Approaches to the Reform of Procedural Law in the Light of Systemic Impact of the Substantive Law on Civil Process, and «private inclusions» of Substantive Law on the Procedural Matters

The article is devoted to the impact of the substantive law on civil process. There is no doubt that the substantive law is most directly affects civil process but that impact is not always in the same way. In our view, it is possible to talk about the areas of influence of the substantive law on civil process that could be described as a system. It sets a certain systemic effects’ vector, that is sometimes even if not explicitly, that permeates the basic start and basic institutions of civil process. The impact of the substantive law on allocations on the civil process types of production. The current APC and CPC RF built on the model, which is based precisely on the division of the types of production that traditionally allocated to the elements of the claim – its subject matter and the basis, – of course, that can not be understood in isolation from those substantive categories on a way of legal protection, and other objects of civil rights, the legal fact of substantive law. Isolation of a procedural types of claims (e.g., claims for recognition of the award, conversion and indirect claims, class actions) is basically one way or another connected with the controversial substantive relations – or the need for our legal duties included in the content, or with the legal fate, either in his subject composition.
