Hearing of the Dispute in Commercial («Аrbitrazh») Court in the Presence of the Agreement on Foreign Jurisdiction of the Court

This article examines the possibility of adjudication of a dispute in a Russian commercial («arbitrazh») court escaping an agreement on the competence of the foreign court. The possibility to recognize the competence, despite the existence of an agreement on international jurisdiction is a crucial issue since the party opting for the court of a particular country chooses also a tradition of law of enforcement prevailing in such country. Enforceability of the agreement on jurisdiction in favor of the system of courts of the foreign jurisdiction stems from the theory of international civil procedure, according to which, the agreement on the international jurisdiction is an agreement in favor of the judicial system of a country, but not a particular court. Based on the judicial arbitration practice, the authors conclude that the Russian commercial («arbitrazh») court may consider the dispute with an agreement on the competence of the foreign court if the agreement does not meet the requirements of certainty and reality has no derogation effect. In conclusion, the article states on the need for a clear legal regulation of agreements on jurisdiction of the foreign court.
