The Interaction of State Courts and Arbitration: History of This Question

The author reveals the history of the development of cooperation between state courts and arbitration courts in Russia. With the emergence of states and, as a consequence, the state courts in all countries began actively develop various forms of cooperation between state and arbitration courts. During the first rudiments of Russian statehood, «hearing through the thirds» was the best in class for a control period of fragmentation of ancient Russia. Since that time our country begin to form first quite peculiar form of interaction between state and arbitration courts. The fact that the state courts were established and only win as the jurisdictional authority of the population, they are often forced to «seek support» in arbitration. It should be noted that in the historical period of the interaction of public and arbitrators priority in resolving the contentious relationship was given to the last, but with time, the role of state courts has increased. After the conclusion of the parties disputed legal arbitration agreement, it is subject to mandatory locking (assurance) by civil servants. After 1917, all activities of arbitration have been made by subject to the total control of state courts. The second form of interaction between state and arbitration courts was in some cases imposition of a fine. The third form is the ability to review arbitration decisions. In conclusion, the author notes that many forms of cooperation between state and arbitration courts still exist.
