For the 15th Anniversary of the Russian Action to the European Convention for the Protection of Human Rights and Fundamental Freedoms of November 4, 1950 and its Protocols

The author analyzes the impact of the European Convention for the Protection of Human Rights and Fundamental Freedoms of 4 November 1950. From May 5, 1998 after the date of ratification, the citizens of Russia became possible to access the control body of the Convention to the European Court of Human Rights. It is noted that the Russian Federation as a party to the Convention for the Protection of Human Rights and Fundamental Freedoms recognizes the jurisdiction of the European Court of Human Rights binding on the interpretation and application of the Convention and its Protocols. The author emphasizes that the application of the said Convention by the courts must take account of the European Court of Human Rights to avoid any violation of the Convention for the Protection of Human Rights and Fundamental Freedoms. The Convention for the Protection of Human Rights and Fundamental Freedoms has its own mechanism, which involves the compulsory jurisdiction of the European Court of Human Rights, and systematic monitoring of the execution of judgments of the Court by the Committee of Ministers of the Council of Europe. When a court considers whether to revise the judicial act considered a causal link between the European Court of Human Rights violation of the Convention or the Protocols thereto, and the adverse effects that continues to be the applicant.
