Submission of Additional (New) Evidence to the Court of Appeal: the Historical and Legal Analysis of Contemporary Issues (the 10th Anniversary of the Code of Civil Procedure of the Russian Federation)

The article is devoted to the further formation of appeal in the courts of general jurisdiction, the submission of additional (new) evidence in a court of second instance in connection to the fact of entered in the Code of Civil Procedure of the Russian Federation changes of the existing jurisprudence. Historically, the 1864 Charter of Civil Procedure introduced incomplete appellation in Russia, but in practice it has transformed into a full appeal. However, the implementation in practice mode of full appeal implied the possibility of representing the parties and taking evidence in the court of second instance without restrictions. Therefore, such evidence shall be taken and considered by the Trial Chamber who based their actions on the decisions of the Civil Cassation Department of the Governing Senate. After 1917, the possibility of presenting new evidence to the court of second instance is not directly regulated, but the ban was absent. The question of the legality and validity of solutions discussed on the basis of data collected by the court of first instance and available in the case. Due to the fact that the legislation provided restrictions for the submission of new evidence for persons involved in the case, there was no resolution of this issue depended entirely on the discretion of the court. Later, the practice was formed, under which additional materials submitted by the parties and requested by the court itself can not serve as a basis for change or giving a new decision by the court of second instance, because they have not been the subject of investigation by the court of first instance with the participation of all stakeholders and compliance with statutory regulations. At the present stage of development of civil procedure as in the stage of transition to the appeal proceedings under the rules of the court of first instance in determining whether other violations of procedural rights under Part 4 of Art. 330 Code of Civil Procedure occurred, all presented additional evidence shall be admitted without restriction.
