The Code of Administrative Proceedings: the Evaluation of the Prospects

The article analyzes the draft Code of Administrative Procedure in terms of its interrelations with the rules of recent procedural codes governing the production on cases arising from public relations. The author notes that the draft Code of Administrative Procedure introduces important conceptual status of the draft law, it introduces a single administrative proceedings to consider cases on the applications of citizens and legal persons to contest the decisions, actions (inaction) of state bodies, officials and other proceedings arising out of public relations. And also to deal with certain categories of cases on administrative offences of citizens, officials and legal entities, which are punishable under the Code of Administrative Offences. The author concludes that the need is not so much in the Code of Administrative Proceedings, as in the Code of Administrative Procedure, according to the rules of which courts will be dealt with the case of the appointment and appeals of administrative penalties. Code should be full, detailed and should guarantee the rights of persons subject to administrative liability. Just because of that there are need of administrative courts.
