A.V. Argunov’s monograph «Special Production in a Civil Procedural Law of Russia and France» is subjected to the review. In the theoretical plan A.V. Argunov’s reasonings the definition of concept of justice through the body which is carrying out this activity, and get throught possibility of identification of signs of justice through a functional orientation of this activity. It is necessary to agree with the revealed author that an originality of activity of court on hearing the cases of special production, also excellent on a number of signs from similar activity by hearing of cases of claim production. Conclusion repeatedly formulated on pages about such criterion of special or guarding legal proceedings, as a presumption of lack of dispute on the right which is cardinally distinguishing it from, for example, claim production where the presumption returns – existence of dispute on the right of civil works is represented to one of the most important one.
