Civil proceedings: general characteristics and trends

In article shared problems of unity and differentiation of civil legal proceedings are considered most, comparison of the remedial institutes fixed in the Civil remedial code of the Russian Federation and the Arbitration remedial code of the Russian Federation is spent. The conclusion about the essential similarity of the specified institutes reflecting unity of civil legal proceedings becomes. Some distinctions in standard fastening of the specified institutes in remedial codes, reflect features of their display during consideration and the permission of civil cases in courts of law and arbitration courts. The given circumstance allows to draw a conclusion on expediency of fastening of institutes of a civil procedural right in the uniform Code of civil legal proceedings with reflection in it of features of display of those or other remedial institutes with reference to stages of civil legal proceedings and consideration of separate categories of civil cases, including the affairs subordinated to arbitration courts.
