ON THE “BENEFIT” OF HIGHER LEGAL EDUCATION

The main topic of the article is the discussion of the doctrinal, legislative and applied nuances
of introducing educational qualifications in the arbitration process for representatives,
highlights the history of the issue and the results of a mini-sociological study. As the results
of the analysis of all aspects of the problem, the author gives recommendations on the
application of the norm. In particular, the author notes that now, when the beginning of
professionalization has been laid, the author does not at all call to return to what was. The
best option is, in our opinion, the introduction of a mixed system, that is, when everyone
who has the appropriate powers, formalized in a power of attorney or other legal document,
gets admission to meetings. Let them be – even as a mandatory supplement to a lawyer,
after all – the presence of a lawyer, after all, both disciplines and morally encourages: he can
immediately and competently respond to an unexpected petition of the enemy and suggest
a word and participate in a meeting of lawyers.
