This article justifies the public law nature of procedural agreements and proves the
impossibility of contractual regulation of civil procedural relations. The definition of
procedural agreements is formulated on the basis of the criteria of their differentiation
with civil contracts. The author considers them as coordinated procedural actions of the
parties and other participants, directed to the choice of one of the alternative rules of civil
legal proceedings, provided by the law, acting as the legal fact-conditions of realization of
procedural laws and within completed actual structure obliging court to commit reciprocal
procedural actions directed to application of consequences of the reached agreements.
In the article the variety of procedural agreements is revealed and their classification by
various bases is given. The importance of differentiation of procedural agreements and civil
contracts for the correct solution to questions of applicable law to the relations complicated
by a foreign element is proved; about the right of the parties to conclude agreements which
are not provided by the federal legislation; about the volume of their capacity; about forms
and ways of protection of the rights violated by this or that agreement; about powers of
court, on assistance in achievement of the specified agreements.
