The article examines the relevance of regarding judicial customs and judicial habits as
sources (forms) of the Russian civil procedure law. The author points out that the use of the
term “custom” in jurisprudence without any additional specification is uncertain, hence in
this sphere it is necessary to apply the “legal (judicial) custom” notion. As for the conditions
required to consider a judicial custom as a source (a form) of law, those enumerated are
approval by the state, legal certainty and compliance with the law. Alongside this, acceptable
methods of approving customs are analyzed, and the necessity of setting judicial customs
apart from such phenomena as habits and introduced order is underlined. As a result,
the author draws the conclusion that in the Russian Federation there are no emerging
legal (judicial) customs which could become sources (forms) of civil procedure law, while
habits arising in courts should be taken not as a form of law, but as a probable basis for
appearance of new judicial norms and as a force having an influence on the creation of
a norm contained in enacted law.
