PRESUMPTIONS AND FICTIONS OF RECEIVING NOTICES
AND OTHER JURIDICALLY MEANINGFUL MESSAGES

The article presents the issues of legitimizing and legal use of presumptions and fictions of
receiving juridically meaningful messages in procedural and substantive branches of the
private law. When a juridically meaningful message is sent, the most important emphasis
is placed on the fact of its receipt, since the legally set messages resulting from this message
occur right after it is received. In the majority of cases, the fact of the juridically meaningful
messages receipt by the addressee is established via presumptions and fictions. In the article,
the explanations are given with regard to the difference between the presumption of receipt
and the fiction of receipt, this difference being in their logical-legal nature and method of
formation. The presumptions of the message receipt are based on a high probability of the
fact that the addressee has actually received the message, while the fictions are designed
by the legislator when it is reliably known that the addressee has not in fact received
the message. With this, both presumptions and fictions are irrefutable in the institution
of juridically meaningful messages. It is proved that institutionalization of the message
delivery fiction in the legislation does not have any legal sense, as the message delivery is not
within the addressee’s control scope. For this reason, the message delivery should be replaced
with the fiction of the receipt of the juridically meaningful message by the addressee. The
conclusion was made that following the procedural norms, the presumptions and fictions
of juridically meaningful messages receipt should be also fixed in the substantive law.
