In paper are discussed problems of introduction digital rights into Russian civil law in the
view of procedural discipline. The Authors marked that conditions in that Russian Federation
allows defending boned with digital rights circulation relations aren’t enough in key virtues
restriction: anonymity, fast circulation, low costs for disposes regarding that kind of civil rights
objects. Russian law science in that particular moment didn’t adopted strict concept to define
the essence of the new civil rights objects so legal circulation will be below in comparison
to underground market in addition to uncomfortable financial activities according digital
rights. The Authors analyzed materials of practice of arbitrage and ordinary courts related
to significant part of case law in the field of digital law; opinions top public officials and
other public authority, which related in positions in particular cases in many ways. Also,
generally that agencies have taken positions that digital rights insufficiently defined, so it can’t
contribute to stability of business and satisfy the printsiple requirements of law.
