ON THE REFORM OF CIVIL PROCEDURE IN 2018–2019:
A VIEW FROM ABOVE

In this article, the author considers and analyzes the procedures for reforming the civil
procedural legislation, which began in 2018 and ended in 2019, which managed to enter
the history of the development of procedural legislation, as well as procedural thought, as
a “procedural revolution”. One of the aspects highlighted in the framework is the recognition
of jurisdiction – a procedural regulator in the framework of a single civil procedural
form. Another aspect considered by the author is the universalization and increase of the
procedural qualifying component of procedures other than the general civil procedural form,
the movement in the direction of horizontal differentiation of civil procedure according to
the procedural criterion. Also, the integration of the institution of conciliation procedures,
including a settlement agreement, is highlighted – a de facto demonstration of a new method
of achieving the goals of the process by resolving a dispute by the expression of will of interested
parties. In addition, the procedural revolution has returned everyone to such an instrument
for protecting rights and legitimate interests as a class action. The contemplation of these
reforms, the reform of the court system and other metamorphoses and transformations have
yet to be evaluated, both from a scientific point of view and in the context of their effectiveness.
At the same time, it now makes sense to conduct an analysis and build some forecasts that
define the further vector of the development of procedural science and practice.
