OF JUDICIAL REVIEW IN CIVIL PROCEDURE

The article is devoted to the problems of proof at the stage of verification of the judicial acts in
civil, economic and administrative cases. The author notes the reduction of the powers of the
court in the field of evidence in the framework of judicial verification in the last two decades:
of the five courts, only two are able to respond and eliminate the errors found in matters of
fact. Based on the results of the study, the author comes to the conclusion that the limited use
of adversariality, concentration of the process and procedural savings are reasonable within
the scope of evidence in verification judicial activity, the need to abandon the conditional
nature of evidence in the court of appeal, the rationality of removing restrictions on the
re-evaluation of evidence already collected by the first and appeal instances by the courts
cassation and supervisory authority. The author also concludes that it is inappropriate to use
the category of abuse of procedural law as a criterion for limiting the powers of the parties
to prove: abuse of procedural law is impossible, because the parties perform all procedural
actions within the limits established by the procedural law, and limiting the possibility, first
of all, of the court of appeal to collect and the study of new evidence, even hidden by the
parties from the trial court, prevents the correction of potential judicial mistakes.
