MODERN PROCEDURAL LAW:
UNIFICATION AND DIFFERENTIATION?

In this article, the author considers and analyzes the grounds for differentiation and
unification of civil, arbitration, administrative procedural law, compares the subject and
method of their legal regulation. The article analyzes the practice of courts of general
jurisdiction in considering cases of bringing to administrative responsibility in accordance
with the rules established by the Code of Administrative Offenses of the Russian Federation.
Procedural branches of law are considered as related branches of law. Examples of “soft”
unification of procedural law while maintaining independent procedural codes are given.
In conclusion, the author notes that today it is taken for granted that in addition to the
maternal branch of civil law, family and housing exist and are successfully developing. At
the same time, a similar differentiation has become widespread in procedural law: first, in
relation to two types of courts: courts of general jurisdiction and arbitration courts. Then
the differentiation of civil procedural law went further – to the allocation of administrative
procedural law. It is enough to compare the general part of the Civil Procedure Code,
Arbitration Procedure Code, Code of Administrative Procedure, types of review of judicial
acts and much more, and we will see, if not duplication of regulations, then their indisputable
similarity, which, in turn, indicates the presence of signs of unification.
