The system of protection of human rights and freedoms is a combination of both state and
non-state methods. A mandatory criterion for non-state or private methods is the absence
of a direct ban on their use in a legal act. The traditional institution of private methods
of protection includes alternative dispute resolution. In this article alternative dispute
resolution is considered through its understanding as one of the institutions of the system
of non-state methods of protection in national law, which includes both forms enshrined
in the law such as arbitration, mediation, and not fixed – negotiations; the authors reflect
the different approaches to the understanding of “alternative” in the ADR (alternative
dispute resolution). The question is raised about the possibility of considering alternative
dispute resolution as a collective form of implementation of the Institute of reconciliation,
based on the fundamental purpose of these procedures. Theme of arbitrability of disputes
and possibility of ADR from the position of the rule of law are considered. Also the main
components of conflict resolution procedures are defined.
