CASES ON PREVENTION OF HARM IN THE FUTURE
(ON THE EXAMPLE OF GENOMIC RESEARCHES AND IMPLEMENTATION
OF THEIR RESULTS IN PRACTICE)

The article analyzes the peculiarities of consideration and resolution of cases on the prevention
of harm in the future in relation to a new direction of research and innovation – genomic
research and the implementation of the results (products, technologies) obtained on their
basis (primarily medical). The author emphasizes, a number of problematic aspects of the
application of Article 1065 of the Civil Code of the Russian Federation as a whole, especially
to economic activities, new technologies, are unresolved. For example, the place of the
obligation arising in connection with the threat of causing harm in the system of civil and
legal obligations; the range of possible plaintiffs in such cases; the conditions under which the
court satisfies the claim; burden of proof for this category of cases requires attention to clarify.
In this regard, the relevance of this issue as the development of genetic research will grow.
The aim of the study is to identify the peculiarities of cases on the prevention of harm in the
future (for example, genomic research and development implemented in practice). The study
of this topic was carried out on the basis of application of general scientific (analysis, logical,
induction, deduction, synthesis) and private law methods (formal legal, etc.). Based on the
study, the author finds significant difficulties for the courts in cases of claims for termination
(prohibition) of the subject (defendant), which, in the opinion of the plaintiff, can cause
harm to his health or life, as well as the health or life of others. In connection with the results
obtained, the author concludes that it is necessary to further develop both the substantive and
legal institution of obligations to prevent future harm and procedural norms that contribute
to the full and timely consideration and resolution of such cases in Russian courts.
