OF EVALUATION OF DIGITAL EVIDENCES

IN CIVIL PROCEDURE

The article deals with the issues of legal regulation of the order of examination of digital

evidence in civil procedure. It gives an actual example that illustrates the unpreparedness of

the judges to evaluate the digital world reality, their inability to establish the facts of the case

that takes place in digital world, electronic networks, their unpreparedness to substantiate

facts connected with the appearance of digital clones of the citizens (virtual taxpayers in

the example given), as well as to make a proper investigation of the evidence that proves

the stated circumstances because of the lack of proper legislative reglamentation of the

procedure of assessment of digital evidence. It is concluded that the norms embodied in

the current legislation do not possess the full regulation of “digital justice” that is to a large

extant regulated by the acts that are not acknowledged as sources of law. Due to this fact,

the author states and proves the necessity of including the new acts to the system of sources

of Russian procedural law, comes up with suggestions about defining the order of their

adoption and the sphere of their regulation that should include the issues of regulation of

the order of addiction and evaluation of digital evidence, in order to eliminate the conflict

between the procedural law and existing legal reality.
