When deciding on the recognition of a property as real estate, it is necessary to establish
whether it has signs that can be attributed by virtue of its natural properties or on the
basis of the law to immovable objects. It is an often situation when the outcome of the case
depends on the status of the object as either movable or immovable, and the line between
movable and immovable property is very thin. The authors derive the criteria for attributing
things to the concept of real estate and consider judicial practice. The procedural features
of the consideration and resolution of this category of cases depend on this circumstance.
The article examines the question of the possibility of appointing an examination in court
regarding the possession of a thing by signs of real estate. Problems in the legal definition
of the concept of real estate are indicated. Practical recommendations are given that can
help to conclude that the disputed property is recognized as immovable.
