EVIDENCE IN DISPUTES ABOUT CHILDREN:
SOME THEORETICAL, PRACTICAL AND VALUE ISSUES

The article analyzes the features of proof in family disputes about children. From a procedural
point of view, disputes about children are characterized by a wide range of circumstances
included in the subject of proof, and as a consequence a great deal of evidence should be
collected, investigated and analyzed by the court. The author considers the issues related to
the identification of the child’s opinion, the appointment of examinations for the diagnosis of
intra-family relations and the establishment of psychological characteristics of each parent.
It is proved that considering disputes about children and analyzing evidence, the judge must
follow not only the law, but also operate knowledge in the sphere of pedagogy, psychology,
psychiatry, take into account the norms of morality, customs and family values. The court
must give priority to the upbringing of the child by both parents and make every effort to
reach an amicable agreement in the dispute over the child.
