IN THE LIST OF CREDITORS OF THE DEBTOR

Insolvency (bankruptcy) cases constitute a significant category of cases adjudicated by
arbitration courts, being one of the most difficult categories of cases, and the specificity of
cases gives rise to a significant number of abuses to conceal (withdraw) the debtor’s property,
to create an appearance of debt. The author, using the example of a category of separate
disputes to include claims in the register of debtor’s creditors’ claims (the most significant
category for the purpose of examining procedural features of evidence in bankruptcy cases),
analyzes the reasons for cancellations by higher courts of the judiciary, and talks about the
importance of analyzing the judicial practice of the Judicial Chamber on Economic Disputes
of the Supreme Court of the Russian Federation. The article analyzes the highest court’s
practice on application of rules of proof in separate disputes consideration on inclusion
in the register of debtor creditors’ claims, features of proof; proposals are made in order
to improve the existing arbitration procedural legislation in terms of the court’s actions
sequence regulations to determine a subject of proof both in case preparation for a trial
and in its future consideration, to impose a burden of proof of certain circumstances on
a person involved in the case.
